How much notice you need to give
Philippines
On our reading of Article 300 of the Labor Code (Article 285 in the original decree), you give your employer at least one month's notice in writing. The law says:
"An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one month in advance. The employer upon whom no such notice was served may hold the employee liable for damages."
On our reading of Article 300(b), you can leave without notice only for just causes: serious insult, inhuman and unbearable treatment, or a crime or offense against you or your immediate family by your employer or their representative, and causes like these. For anything else, ask your manager to agree to an earlier last day, and get the yes in writing.
Malaysia
On our reading of section 12 of the Employment Act 1955, your notice period is the one written in your contract. No notice period in your contract? Section 12(2) sets one by how long you've worked there: at least 4 weeks under 2 years, 6 weeks from 2 to 5 years, and 8 weeks for 5 years or more. Notice has to be in writing, and either side can waive it.
Section 13 also lets you leave without serving notice if you pay your employer the wages for the notice period. The Act applies to Peninsular Malaysia and Labuan, so in Sabah or Sarawak, go by your contract.
This is general information, not legal advice. Your contract and company policy can add steps, so read them or ask HR before you hand in your letter.
How many days' notice do I give when I resign in the Philippines?
At least one month, in writing. Article 300 of the Labor Code says you serve "a written notice on the employer at least one month in advance", which most people count as 30 days. Your contract may set its own process, so check it before you hand in your letter.
Can I resign effective immediately?
Only in some cases. On our reading of Article 300(b) of the Labor Code, you can leave without notice for just causes: serious insult, inhuman treatment, or a crime against you or your family by your employer or their representative. Otherwise, ask your employer to agree to an earlier last day, and keep their yes in writing. Leaving without notice and without a just cause can make you liable for damages.
Do I have to give a reason in my resignation letter?
No. You can write "personal reasons" and leave it there. A line of thanks still helps when you need a reference later.
Can I send my resignation letter by email?
Yes, if your company takes resignations that way. Put your name and role in the subject line, and keep the sent email as your copy. If HR wants a signed printout, send that too.
When do I count the 30 days from?
On our reading, from the day your employer gets the letter. So date it, and keep proof they received it, like a signed copy or an email reply.
How much notice do I give in Malaysia?
The notice period in your written contract. If it doesn't set one, section 12 of the Employment Act 1955 sets at least 4, 6 or 8 weeks, depending on how long you've worked there: under 2 years, 2 to 5 years, or 5 years or more.
